Distribution rules
 
 
 
 
 
 
 
The SCPP distributes the money collected on their behalf to its members. Specific
computer systems correlate each actual use with a precise fee.

 
Equitable remuneration
 

Equitable remuneration is mainly distributed according to the usage returns supplied by users to the SPRE, showing all the track titles used for the last year and the period of transmission. The amount allocated to each sound recording depends on the total transmission duration during the year. Fees are distributed in proportion with this duration compared with the total duration of transmission of all the sound recordings transmitted for a given user. Fees are distributed in June and November following the year of collection.
 
  · Radio
 
The following are used:
 
  • Broadcasting returns from private local stations (Fun, Nostalgie, NRJ, Chérie FM, Europe 2, RFM, Skyrock and RTL2), national stations (RTL and Europe1) and Radio France.
 
  • Weighted schedule returns from non-affiliated local stations monitored by Ipsos.
 
  • Sales returns supplied by producers if no usable broadcasting return is available.
 

· Sound systems in public places (shops, hypermarkets, cafés, restaurants, etc)
 
The following are used:
 
  • Returns from the main sound system professionals.
 
  • Broadcasting returns from the main radio stations.
 
  • Sales returns supplied by producers if no usable broadcasting return is available.
 
  · Clubs
 
Fees received from clubs are distributed using the results of automated electronic monitoring carried out in 109 representative clubs by Media Control on behalf of the SPRE.

Television
 
Distribution in proportion with the number of broadcasts is not yet possible because of the quality of the returns provided to the rights owners. The SCPP therefore distributes the fees collected in proportion with sales and duration of sound recordings.  

Private copying
 
  · Private audio copying Most of the fees collected on behalf of producers are distributed in proportion with sales and duration of sound recordings. The remainder is distributed in proportion with the duration of radio broadcasting of sound recordings. Fees are distributed in June and November following the year of collection.

Private audiovisual copying
The SCPP distributes revenue received in proportion with rights owners’ total broadcasting revenue for the same period. Fees are distributed in June and November following the year of collection.
 
 
Licensing right

Sound recordings
Other uses are covered by the producer’s licensing right. In these cases, the user concludes a contract with the SCPP to obtain reproduction, supply and public communication rights. Under general contracts of common interest, the user supplies transmission and/or reproduction returns listing track titles, performers’ names and/or the actual duration of transmission of sound recordings communicated to the public. Fees are distributed in June and November following the year of collection.  

· Public sound systems
While transmission comes under equitable remuneration, reproduction of sound recordings is covered by the licensing right, for which sound system operators pay a fee. This is distributed according to the number of hours of reproduction of the sound recordings in the producer’s catalogue.  

· Supply and use of telephone music-on-hold
Fees received in return for the reproduction right and the public communication right are distributed to each producer according to the actual use of their sound recordings (number of reproductions and number of lines). See details at the end of this brochure.  

·
Music videos
In the case of general entertainment channels, fees are distributed each month. A predefined tariff is applied to each broadcast declared by the user. In the case of music channels, fees are distributed quarterly. The fees depend on the broadcaster’s revenue, with a guaranteed minimum amount.
 
 
  Distribution of financial income: All financial income earned during the year is distributed to the members in December of the same year.
