Preamble
The SCPP
(Société civiles des Producteurs Phonographiques) is a collective management
organization that collects and distributes fees collected on behalf of its
members from users of sound recordings and music videos.
The SCPP carries
out this task in particular through its website www.scpp.fr (hereinafter the
“Site”).
Use of the Site
is the sole and exclusive responsibility of the person accessing it.
The user is
responsible for implementing the means allowing access to the Site. It is also
their responsibility to ensure that any person accessing the Site through their
internet connection is aware of these General Terms and Conditions of Use.
By accessing the
Site, the user agrees not to commit any act likely to damage the SCPP’s image,
interests, or rights or, which could damage, render unusable, or overload the
Site or, which could in any way hinder the normal use of the Site by other
visitors.
The SCPP uses
reasonable and security measures to detect viruses. However, users should be
aware that the existing security measures for protecting computer systems on
the internet are not entirely reliable and, we therefore cannot guarantee the
absence of viruses or other elements which may alter the systems (hardware and
software) or data and files contained in these systems.
1. Purpose of the Site
The Site,
published and hosted by the SCPP, has been designed to meet the expectations of
its members by offering them tailored services to facilitate collecting and
distributing royalties for their related rights, but also informing the public
about the rights of producers of sound recordings and music videos, as well as
users about the obligations resulting therefrom.
2. Acceptance of the General Terms and Conditions of Use (GTC)
Access to this
Site (www.scpp.fr) by the user is subject to the unreserved acceptance of its
general terms and conditions of use (GTC). Acceptance of these GTC, which are
subject to French law, is done online during your first visit to the site and
is equivalent to signing. Simply browsing the Site therefore implies acceptance
and application of these conditions.
The SCPP
reserves the right to modify all or part of the GTC as well as the information
contained on its Site at any time without notice or to suspend access to it.
In the event of
a change, the new GTC shall take effect on the date they are posted on the
Site.
3. Intellectual Property
All of the
Site’s contents, especially texts, graphics, photos, images, sounds, logos,
trademarks, software, features, creations and various copyrightable works,
databases, information, and other data cannot be used for any other purpose
than those expressly authorized or required by browsing the Site.
Any
reproduction, representation, distribution, decompilation, marketing, or making
the contents of the Site available in whole or part in any way whatsoever,
whether free of charge or not, is expressly prohibited without the SCPP’s
prior, written consent.
Pursuant to
Articles L. 335-2 et seq. of the French Intellectual Property Code, any
reproduction, representation, or distribution by any means whatsoever of
content in violation of the rights of its owners constitutes a criminal offense
of counterfeiting. It may also result in a violation of image rights, personal
rights, or any other rights and regulations in force. The perpetrator shall
thus be exposed to criminal and civil penalties.
4. Liability
The SCPP ensures
that the information placed on its Site comes from sources that are deemed to
be reliable. Despite frequent updates, it is nevertheless possible that the
Site’s content contains errors, inaccuracies, or omissions. This is why the
SCPP cannot guarantee the total accuracy and comprehensiveness of the
information contained on this Site.
The SCPP cannot
be held liable for any direct or indirect damage, regardless of the causes or
consequences, resulting from viewing this Site (and/or the sites linked to it),
its use, the use of the information it contains, or the impossibility of
accessing it.
The Site may be
suspended by the SCPP at any time for the purposes of technical maintenance,
updating the information published, or for reasons of force majeure. The SCPP
declines any and all liability for this.

links pointing from the Site to other sites
In order to
facilitate users’ access to information about the world of music production,
the SCPP has made links available on its Site to external websites.
The SCPP cannot
be held liable for the content, advertising, products, and services available
on these sites.
Furthermore, it
cannot be held liable for the continuous quality of these sites. Since these
sites are completely independent, the SCPP cannot exercise control over their
content which may be changed, updated, or deleted at any time by their
publisher.
2. Links
Pointing to the Site
Any creation of
a link pointing to the Site is done under the sole responsibility of the person
who created the link and the SCPP cannot be held liable. The SCPP reserves the
right to request that these links be removed, particularly when the site
hosting the link is detrimental to the SCPP’s rights or reputation.

Pursuant to the
provisions of the General Data Protection Regulation of April 27, 2016 (known
as the “GDPR”) and Law no. 78-17 of January 6, 1978 on data processing, files,
and individual liberties, as amended, the SCPP hereby informs the user that:

The SCPP is the data controller of the data
collected on the Site.

The data is processed for the sole
purpose of complying with the requests that the user has made on the Site,
either from the forms or using the "Contact" section
(declaration, registration, requests for various information, complaints,
etc.). The personal data that you provide on the Site may also be used for
statistical purposes relating to the number of visits to the Site.

This processing is based on the SCPP's
legitimate interest in order to best respond to your requests and improve
the quality of our services.

The data is kept by the SCPP only for the
time necessary to process user’s requests.

completed. If you do not answer one of these mandatory items, your

Only the SCPP’s staff members in charge
of processing requests in the performance of their duties are recipients
of the personal data that you communicate via the Site. The SCPP does not
transfer, assign, or rent your data for a fee or free of charge.

personal data as part of its Site and in its reserved areas is contained
in its own terms and conditions of use.
In accordance
with the laws on personal data protection, users have an individual right to
access, rectify, oppose, restrict processing, and delete their personal data.

that you do not receive a satisfactory response from the SCPP, you may file a
